Q: What is the compensation for?
A: The reduction in value of a property as a direct result of noise, smell, fumes, smoke etc caused by public traffic using the new road once it is completed. It is not possible to claim for a reduction in value caused by the loss of a view.
Q: Can I claim for the disruption I suffer during the construction period?
A: No. You can only claim for a reduction in value of your property caused by use of the road once it has opened.
Q: Who can claim?
A: The owner of the property. You must own the property both when the road is completed and when the claim is submitted, at which time the property must be occupied either by yourself or a tenant. Landlords, long leaseholders and Housing Associations may also claim.
Q: Do I need to instruct you now - the scheme is not due to open for several years?
A: It’s best to instruct us as soon as possible - we can then provide you with regular updates on the progress of the scheme and answer any queries that you have during this time.
Q: When will my claim be submitted?
A: Usually one year after the road opens to traffic. However, if you sell your property within 12 months of the road opening your claim should be submitted between exchange of contracts and completion of the sale (between the date of missives and date of Entry in Scotland).
If the road opened over 12 months ago, we should be able to submit your claim as soon as you provided us with the required information.
Q: How much will it cost me?
A: Generally there is no charge; the highway authority will make a payment towards our fees if your claim is successful. If it is unsuccessful, we won’t charge you provided we are the only agent acting on your behalf.
On some road schemes we work on a ‘no win – no fee’ basis; and this is made clear when you instruct us. In the case of certain schemes where we charge a fee this will only be a small percentage of the any compensation awarded, but obviously, if the claim is unsuccessful, no fee is payable provided we are the only agent instructed.
